Terms of use

Last updated November 3, 2026

These terms are an agreement between you and Doner Haus Franchising LLC, a Florida limited liability company, on behalf of itself and its affiliates, including its parent company, Doner Haus, Inc. (“Döner Haus,” “we” and “us”). They apply to our websites, including this one and our franchise application, and to the forms, messages and other services that link to them (together, the “sites”). By using the sites, you agree to these terms and to our privacy policy. If you do not agree, please do not use the sites.

Changes to these terms

We may change these terms at any time. Changes take effect when we post them here and update the date at the top, and they apply to your use of the sites after that. Please check this page from time to time.

Using the sites

You may use the sites for your own lawful, personal or business purposes. You agree not to:

  • Break any law, or infringe anyone’s rights, through the sites.
  • Give false information, or pretend to be someone else.
  • Send spam, malware or anything harmful, abusive or offensive.
  • Try to get into parts of the sites, systems or accounts you are not authorized to use, or interfere with how the sites work.
  • Copy, scrape or harvest the sites or their content with bots or other automated means, except for search engines indexing public pages.
  • Use the sites to build a competing product or service.

We may change, suspend or stop any part of the sites, and limit or end anyone’s access, at any time and for any reason, without notice.

Orders, rewards and partners

Online ordering, payments, gift cards, rewards and delivery are provided by third-party ordering, payment and delivery providers, such as Toast. Their own terms and privacy policies apply when you use them. We are not responsible for those services.

Menus, prices, hours, promotions and availability may vary by restaurant and change without notice, and may contain errors. We may correct errors and cancel or limit offers at any time.

Franchised restaurants

Many Döner Haus restaurants are independently owned and operated by franchisees. Each franchisee is a separate business and is solely responsible for its restaurant, its employees and its dealings with you. Döner Haus is not responsible for the acts or omissions of any franchisee.

Food and allergens

Allergen and ingredient information is provided for general information only, may not be complete or current, and may change. Our kitchens handle common allergens and may share equipment and surfaces, so we cannot guarantee that any item is free of any allergen. If you have a food allergy or dietary need, please ask the restaurant before you order.

No franchise offer

Nothing on the sites is an offer to sell, or a solicitation of an offer to buy, a franchise. We offer franchises only through our Franchise Disclosure Document and where permitted by applicable law. Submitting an inquiry or application does not create any franchise, agreement or obligation, and does not guarantee that we will offer you a franchise.

Certain states regulate the offer and sale of franchises. If you live in one of those states, or want to open a franchise there, we will not offer you a franchise until we have complied with that state’s applicable pre-sale registration and disclosure requirements.

New York: this is not an offering. An offering can only be made by a prospectus filed first with the Department of Law of the State of New York. Such filing does not constitute approval by the Department of Law.

Financial performance representations, if any, are made only in Item 19 of our Franchise Disclosure Document. Nothing else on the sites is a promise or prediction of the sales, income or profit you might earn.

Messages and calls

If you give us your phone number, we may call or text you, including about the request you made. Message frequency varies, and message and data rates may apply. Reply STOP to stop texts or HELP for help. Carriers are not liable for delayed or undelivered messages. For an emergency, call 911.

Our content and marks

The sites and their content, including text, photos, videos, graphics, logos and the Döner Haus name and marks, belong to Döner Haus, its affiliates or its licensors, and are protected by intellectual property laws. You may view and share our pages for personal, non-commercial use. You may not otherwise copy, modify, distribute or use our content or marks without our written permission.

Your content and feedback

When you send us messages, reviews, photos, ideas, suggestions or other content (“your content”), you keep any ownership you have, and you give Döner Haus and its affiliates and franchisees a perpetual, irrevocable, worldwide, royalty-free, transferable and sublicensable license to use, copy, edit, adapt, publish, display and distribute it, in any media, for any purpose, without payment or credit to you, subject to our privacy policy. You may not send content you do not have the right to share, and you are responsible for what you send. We do not have to use, keep or respond to your content, and we may use any idea or suggestion without obligation to you.

Other websites

The sites link to websites and services we do not control. Those links are for convenience, and we are not responsible for their content, products or practices.

Disclaimers

The sites and everything on them are provided “as is” and “as available.” To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy and uninterrupted or error-free service. We do not promise that information on the sites is current, complete or accurate. Information on the sites is general information, not legal, financial or professional advice.

Limitation of liability

To the fullest extent the law allows, Döner Haus, its affiliates and franchisees, and their owners, officers, employees and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any lost profits, revenue, data or goodwill, arising out of or relating to the sites or these terms, even if we were told such damages were possible. Our total liability for any claim arising out of or relating to the sites or these terms will not exceed one hundred dollars. Some laws do not allow these limits, so some of them may not apply to you.

Indemnity

To the extent the law allows, you agree to defend, indemnify and hold harmless Döner Haus, its affiliates and franchisees, and their owners, officers, employees and agents, from any claims, losses, liabilities and expenses, including reasonable attorneys’ fees, arising out of your content, your use of the sites or your breach of these terms.

Governing law and disputes

These terms, and any dispute arising out of or relating to them or the sites, are governed by the laws of the State of Florida, without regard to its conflict of laws rules, except where the law of your state requires otherwise. You and we agree that any such dispute will be brought only in the state or federal courts located in Miami-Dade County, Florida, and you consent to the jurisdiction of those courts. To the extent the law allows, any claim must be brought within one year after it arises.

A franchise agreement, development agreement or other signed agreement with us is governed by its own terms, and these terms do not change it.

General

These terms and our privacy policy are the entire agreement between you and us about the sites. If any part of these terms is found unenforceable, the rest stays in effect. Our not enforcing a part of these terms is not a waiver of it. You may not transfer these terms; we may transfer them, including to a successor in a merger, acquisition or sale of assets. Headings are for convenience only.
